Next year, Texas lawmakers will again look at a statewide ban on smoking in public areas. It will be the fifth legislative session in a very row in which such a measure has become proposed. Like many other critics of such bans, Mr. Geren said he views the Fort Worth ordinance just as one infringement on his rights as a private property owner.
“If I would like to allow smoking, I should have the ability to allow it, ” Mr. Geren said. “It’s my restaurant. ”
Mr. Geren also expressed frustration how the Fort Worth ban carved out and about exceptions for bars and bingo halls, which managed to get easier for those businesses to be able to compete.
“I would have been practical with it if it were a real ban, ” Mr. Geren said.
The Texas Restaurant Association supports a statewide ban, citing the confusion for restaurant owners dealing with a “whole hodgepodge of distinct laws, ” said Kenneth Besserman, this association’s general counsel.
Yet the statewide ban remains unlikely to be able to pass next year, as a substantial contingent of state lawmakers notice it as unnecessary government intrusion, Mr. Scott, of Smoke-Free Texas, said.
“We want to convince the Legislature, but we recognize it may not happen this session, ” Mr. Scott said. “We realize we need to remain building momentum at the regional level. ”.
