Police Losing Battle Against Contraband Cigarettes

Tobacco sales are down. That's good news, right? Not so, say Windsor’s convenience store owners. William Alfaris, owner of Half Price Variety on Drouillard Road, says his cigarette sales have fallen by about two-thirds in the last six years. “I used to sell probably five to six hundred cartons a week. Now I’m down to 150, 200,” he says. The culprit? Contraband tobacco.

“They’re killing us,” says Waleed Jabbou, owner of Waleed’s Corner Store on Seminole Street. “There are a lot of stores selling it. It’s in the neighbourhood, it’s in the parking lot at the Chrysler plant. It’s everywhere.” Just walk around downtown any night and take a look around, Alfaris says. “If you go to any bar, most of the people outside are smoking those contraband cigarettes. It’s just a trend.”

For convenience store owners, that trend is bad news. Cigarette comprise about 65 per cent of sales, Alfaris says. But it’s not just the cigarette sales he’s losing. “When I lose a customer for cigarettes, I don’t just lose a customer for cigarette — he comes in every day for gum, a lighter, whatever,” says Alfaris.

RCMP spokesperson Marc LaPorte says production of contraband tobacco has been on the rise for the past five years, as manufacturing on native reserves has taken off. Most of the contraband cigarette in Canada come from the Akwesasne Mohawk Territory, which straddles the border of Ontario, Quebec and New York State. The cigarette are then trucked all over the province, LaPorte says.

Though the RCMP managed to seize more than 570,000 cartons — each containing 200 cigarette — last year, LaPorte says that’s not alleviating the problem of the illegal cigarette trade. “Our intelligence tells us that we’re seizing only about 10 per cent of what’s out there. “We have stepped up enforcement, but unfortunately enforcement alone is not enough,” he says. “It’s basically a cat and mouse game.”

LaPorte says provincial and federal governments need to work together to stop the flow of contraband tobacco. “Whether there needs to be changes to the laws or talks with First Nations, I don’t know. We need to think outside the box. I don’t think there’s an easy fix.” In the meantime, Windsorites are getting a quick, cheap fix.

A study commissioned by the Canadian Convenience Stores Association released in 2008 saw cigarette butts collected from the ground outside of five high schools in Windsor. Using the presence or absence of a brand name on the cigarette butt and by analyzing the paper, the butts were sorted as to whether they were of legal, illegal, or unknown origin. The study found that 30 per cent of the cigarette were contraband.

With a paltry price tag of two dollars for 25 illegal cigarette stacked up against nine or 10 dollars for 25 premium-brand smokes, it’s no wonder many Windsorites are going underground. “With the economic factors, everybody’s looking for a deal,” says LaPorte. “Cigarette are taxed to a point where they’re expensive to buy, and these are so cheap. Also, people see it as a victimless crime. It’s taking money from the taxman, and most people think the taxman is taking too much anyway.”

While Ontario’s Ministry of Finance and Ministry of Revenue can’t estimate how much tax the government is losing from illegal cigarette sales, the estimated tobacco tax revenue for 2009-2010 is $995 million. President of the Canadian Convenience Stores Association Dave Bryans says about 50 per cent of discount cigarettes on the street are contraband. He estimates the loss of tax revenue to be more than $500 million. “Imagine how many MRIs that could buy,” he says. “Windsor could have had a new hospital if the law had just been enforced.”

Bryans acknowledges the delicate position he’s in by advocating for the enforcement of laws governing the sale of a harmful product. “We sell a lot of contentious products, like lottery and cigarette. But we sell them responsibly and we’re proud of it,” Bryans says. He says unless the contraband problem is corrected, about 30 per cent of convenience stores will close. “Maybe people don’t care about the plight of the small store. But we’re probably the only one that’s still standing in every small town.”

Waleed Jabbou says his store may not last until the problem of illegal cigarette is solved. “I do everything legally. I have three employees I have to pay the taxes and pay everything for them,” he says. “But I’m paying from my pocket now. Very soon I might have to leave the store.”
