Council Votes To Ban All Smoking At Playground For Now

Smoking is not permitted at North Irwin Playground, at least until the end of the year.

North Irwin council passed a resolution to prohibit any smoking cigarettes at the borough's playground, but also discussed potentially designating an area for smokers to light up.

In April, council members agreed to participate in the Penn State University Cooperative Extension's Young Lungs at Play program.

They planned to draft and pass an ordinance as part of the program, which would ban smoking cigarettes at North Irwin Playground.

Young Lungs at Play is an initiative funded through grants from the federal Centers for Disease Control and Prevention, which makes resources, including signs, available to local government agencies to prohibit cheap cigarettes use in playgrounds, parks and recreational facilities.

According to council president Kim Macalus, it would cost the borough at least $300 to have solicitor John Campfield draft the ordinance and advertise it, before council could pass it into law.

Although the cooperative extension pledged to pay half the cost of creating the ordinance, Mayor James Douglas asked council to reconsider an outright smoking cigarettes ban in the park until it could reconvene to discuss it further. Douglas was absent last month, postponing the discussion until Monday.

"The way it would be written, I felt the government's intrusion falls on everything and we have to have a limit," Douglas said.

"I understand no smoking cigarettes where the children are, but to have smoking cigarettes banned is too much. If this ordinance were to have gone through, I would have vetoed it."

Douglas asked council to postpone drafting the ordinance to avoid spending money to have it created, only to have it stonewalled after he exercised his mayoral right to veto it.

The resolution allows council to place the ban on smoking cigarettes temporarily, until it can research a permanent solution, Macalus said.

The resolution also has no monetary costs attached to it, she added.

Enforcement would be left up to the borough's part-time police officer, Michael Kresich, which could become a difficult situation, Douglas said.

"At some point, you have to say enough is enough," Douglas said. "Although this makes everyone feel all warm and fuzzy, we've got other things we've got to worry about."

Councilman Ken Galley said he visited the playground and spotted several people smoking cigarettes while children were playing, which created a noticeable smell. Galley voted in favor of Young Lungs at Play to avoid these kind of situations, he said.

"It's a children's playground," Galley said. "There's no smoking cigarettes in high schools or in (North Irwin) Town Hall, so I don't see the issue. It's a public area, and there are a lot of public areas you're not allowed to smoke cigarettes in."

If council were to designate smoking cigarettes zones, Galley said it should be on the edge of the playground, as far away from the pavilion and playground equipment as possible.

Councilman Brian Crawford suggested council visit the park and discuss potentially designating smoking cigarettes zones, similar to ones established in local amusement parks, such as Kennywood and Idlewild.

Crawford said each member of council should go to the playground to look for suitable areas before the next meeting, so they could make a well-informed decision.

"I don't want to jump to make a designated smoking cigarettes area right now without visiting the park first," Crawford said. "If we're going to do it, we need to do it right."

Councilman Bernie Reynolds was the lone dissenter to the resolution, claiming council shouldn't infringe on a resident's right to smoke.

"If you want to have a smoke, you should be able to have a smoke," he said. "Who are we to tell anyone they shouldn't smoke?"
