Blumenthal Renews Bid To Ban Smoking At Casinos

The state attorney general proposed a law Monday that would ban smoking at Connecticut's casinos by October 2011, an aggressive maneuver opposed by Gov. M. Jodi Rell. Richard Blumenthal, who plans to run for a sixth term as attorney general in 2010, submitted a bill that would ban smoking in phases at Foxwoods Resort Casino and Mohegan Sun. The first phase would prohibit smoking in all non-gambling areas and in 20 percent of gambling areas by October 2009.

"The casinos can't be permitted to gamble with the public health," Blumenthal said at his office Monday while surrounded by Foxwoods employees, officials from the United Auto Workers union, which represents some of them, and public health advocates. A bill supported by Blumenthal that would have banned smoking at both casinos died in the legislature last year. The casinos say a smoking ban would drive away customers.

Rell opposes a legislative ban and says one would lead to a costly legal battle with the Indian tribes that own the casinos. The tribes have maintained that as sovereign nations they're not subject to state law. Rell instead favors negotiating a deal with the casinos to curb smoking without mandating it by law. Last month she reached a nonbinding deal with Mohegan Sun to expand the nonsmoking areas of the gaming floor and elsewhere in the casino complex.

Blumenthal criticized that deal for failing to include Foxwoods, which has been less willing to expand smoking restrictions. A spokesman for Rell said Monday that she would not support a law against smoking at the casinos but stopped short of promising that she would veto such a bill if approved by the legislature.

"Any bill that attempts to impose a solution on sovereign tribes by legislative fiat is certain to result in long, unnecessary and ultimately costly litigation and only complicates good-faith efforts to negotiate a reasonable settlement of the legitimate issues," Rell spokesman Rich Harris said. Connecticut already prohibits smoking in bars and restaurants.

Foxwoods and Mohegan Sun responded tersely to Blumenthal's latest proposal. "The right of our people to govern our land is a rule of law that supersedes the wishes of even Attorney General Blumenthal, and is guaranteed by the U.S. Constitution," Bruce "Two Dogs" Bozsum, chairman of the Mohegan Tribal Council, said in a statement.

The Mashantucket Pequot tribe, which owns Foxwoods, said in a statement that it continues to work with Rell "regarding various matters of shared concern." For now, Mohegan Sun will stick by the expanded smoking restrictions it negotiated with Rell, a spokesman for the tribe said.

Blumenthal would prefer a ban that takes effect sooner than 2011 and said he would be supportive if the UAW can persuade legislators to advance one. But he views a gradual phaseout of smoking at the casinos as more realistic. He also remains open to a negotiated solution. "I'm prepared to discuss the details, but the end-game is nonnegotiable," he said.
